Her ovaries, breasts and uterus were removed. She is claiming €300,000 from public health.

A 24-year-old girl claims more than 300,000 euros from the public health system, this is the first complaint about a change of sex. When he was 16, he began treatment to be a boy with whom his ovaries, breasts and uterus were removed, but now he regrets it.

Their name is Susana. She wasn’t well at the time, which is why she chose to go to the psychologist. That’s when they tell her that what happens to her is that she’s a boy in a woman’s body. It was from there that she began treatment to be a boy.

When Susana became overage six years ago, her breasts, uterus and ovaries were removed. He now considers that the doctors were wrong when they made this decision, that he is autistic and had depression, but his problem had nothing to do with his gender identity. That is why he now demands more than 300,000 euros from the public health, being the first complaint for change of sex.

We spoke with Susana’s lawyer, Carlos Sardinero, who questions whether at that time the maturity of the young woman was valued: “perhaps she was not properly evaluated whether or not she had the intellectual and emotional maturity to perform this type of intervention”.

She says that Susana asked her doctor crying how she could go back: “she arrives crying to her doctor and says, ‘I have had surgery, what can I do to get back to the starting point’. Nothing could be done”.

The Trans Act was passed on February 16 in Congress after several disagreements among government partners.

The main aspect of this Act is that individuals over 16 years of age may apply for a change of sex in the Civil Registry, authorised only with the freely expressed will of the applicant. In addition, mandatory hormone and psychological and medical assessments are eliminated as requirements for persons requesting them.
